Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Buildflin LLC (“STARTLESS”, “we”, “us”), which operates the website at https://startlessco.com and sells the digital resources offered there. By accessing the site, creating an account, or completing a purchase, you agree to these Terms and to our Privacy Policy, Refund Policy and License, each incorporated by reference. If you do not agree, do not use the site.

1. Definitions

• Resource — any digital product we make available, including templates, systems, trackers, guides, kits and bundles, together with any files, documents and updates provided with it.
• Library — the account area where Resources you own are listed and downloaded.
• Order — a completed, paid transaction for one or more Resources.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Tell us promptly at hello@startlessco.com if you suspect unauthorised use. We may suspend or close an account that breaches these Terms or is used unlawfully.

3. What we sell

STARTLESS sells digital Resources delivered as downloadable files or shared documents. There is no physical product and nothing is shipped. Product pages, previews and specifications describe each Resource as accurately as we reasonably can; minor variation between the preview and the delivered files does not make a Resource defective. Some Resources are offered at no charge; these Terms and the License still apply to them.

4. Orders, pricing and payment

Prices are shown in US dollars and exclude taxes unless stated. Our payments, invoicing and sales-tax / VAT / GST are handled by Paddle, which acts as the Merchant of Record and authorised reseller for every paid Order. Depending on where you buy from, the Paddle entity you contract with is Paddle.com Market Limited, Paddle.com Inc. or Paddle.com (Canada) Ltd, as set out in Paddle's Buyer Terms, which also apply to your purchase. When you buy, your contract of sale for payment is with the applicable Paddle entity. Paddle collects and remits applicable taxes and issues your receipt. We set prices and descriptions and deliver the Resource; we may correct pricing errors and decline or cancel an Order (with a refund of any amount charged) where an Order appears fraudulent, mistaken, or in breach of these Terms.

An Order is complete when payment is confirmed and the Resource appears in your Library. If you check out as a guest, we create an account for your email so the Order can be delivered.

5. Delivery and access

Resources are delivered electronically, normally immediately after payment is confirmed, through your Library and, where applicable, by email. Download links are personal, time-limited and must not be shared. You are responsible for having the software needed to open a Resource (the formats and compatibility are listed on the product page). We aim to keep purchased Resources available in your Library indefinitely but do not guarantee availability for any fixed period; download and keep your own copy.

6. Licence to use Resources

Your rights to use a Resource are granted under the License. In summary: you receive a non-exclusive, non-transferable, worldwide licence to use and adapt the Resource in your own and your clients' projects; you may not resell, redistribute or sublicense it. We and our licensors retain all intellectual-property rights in the Resources and the site.

7. Refunds and consumer withdrawal

Refunds are governed by the Refund Policy. Because Resources are digital content supplied immediately, where you are a consumer in the EU, UK or a similar jurisdiction you expressly request that supply begins at once and acknowledge that you thereby lose any statutory right of withdrawal once download or access has started, to the extent the law allows. This does not affect a refund where a Resource is faulty or not as described.

8. Acceptable use

You agree not to:

• copy, scrape, resell, sublicense or redistribute any part of the site or a Resource except as the License permits;
• probe, scan, overload, disrupt or attempt to gain unauthorised access to the site, its accounts, systems or networks;
• circumvent access controls, share accounts or download links, or use another person's account without permission;
• use the site or a Resource to infringe intellectual-property or privacy rights, or for anything unlawful, deceptive or harmful.

9. User submissions

If you send us feedback, ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or obligation to you. Any content you submit must be lawful and yours to share.

10. Third-party services and links

The site relies on third parties — including Paddle (payments), Supabase (accounts, database and file storage), Vercel (hosting) and Resend (email) — and may link to sites we do not control. Their terms and privacy practices are their own, and we are not responsible for them. A Resource may reference tools such as Notion, Google Sheets, Canva or Excel; those tools are provided by their owners under their own terms.

11. Disclaimers

The site and the Resources are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Resources are informational and organisational tools; they are not legal, financial, tax, medical or other professional advice, and results depend on your own circumstances and effort. We do not warrant that the site will be uninterrupted, secure or error-free.

12. Limitation of liability

To the fullest extent permitted by law, STARTLESS and Buildflin LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the site or a Resource. Our total aggregate liability for any claim relating to a Resource will not exceed the greater of the amount you paid for that Resource in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless STARTLESS, Buildflin LLC and its officers, employees and contractors from any claim, loss or expense (including reasonable legal fees) arising from your misuse of the site or a Resource, your breach of these Terms or the License, or your violation of any law or third-party right.

14. Suspension and termination

You may stop using the site at any time and may ask us to close your account. We may suspend or terminate your access, with or without notice, for a breach of these Terms or the License, for unlawful use, or to protect the site or other users. Sections that by their nature should survive termination — including licence restrictions, disclaimers, liability limits and indemnities — survive.

15. Changes to the Terms or the site

We may update these Terms from time to time. We will change the “last updated” date and, for material changes, take reasonable steps to notify account holders. Changes are not retroactive, and continued use after a change takes effect means you accept the updated Terms. We may also add, change or discontinue features or Resources.

16. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules. Subject to any non-waivable right you have to bring proceedings in your local courts as a consumer, you and we agree to the exclusive jurisdiction of the courts located in that jurisdiction. Before filing anything, you agree to contact us at hello@startlessco.com and try in good faith to resolve the dispute for at least 30 days.

17. General

These Terms, with the documents they incorporate, are the entire agreement between you and us about the site and the Resources. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
